It is not permissible for Sharia to take dogs in homes in urban areas, and it is only permissible for hunting and guarding plowing and livestock. The evidence for that is what was narrated on the authority of Abu Hurairah, may God be pleased with him, that the Messenger of God said: “Whoever acquires a dog that is not a hunting dog, nor cattle, or land, it reduces His wages are two carats every day »[1], And what was narrated on the authority of Abu Talha that the Prophet said: “The angels do not enter a house with a dog” [2]. 

The Prophet made ﷺ taking a dog in the house as a reason for the angels not to enter them and for a lack of reward for their owners, and each of these two reasons is an explanation for what he arranged Sharia has implications for him, and two matters have been arranged for him that have no explanation except that they are a punishment for the one who does that. Because the basic principle with the angels is that they exist everywhere except for the place from which they are forbidden, and the basic principle regarding the remuneration for deeds is that the owner fulfills them in full. The lack of angels entering homes and the decrease in the worker's wage is a metaphor for the fact that taking dogs in homes is a sin in the scale of Sharia.

In order to restrict the use of dogs other than what the Sharia permits, the Prophet forbade buying and selling them. On the authority of Abu Masoud al-Ansari, the Prophet, may God’s prayers and peace be upon him, forbade the price of the dog, the dowry of the prostitute and the priest's dowry [3]. On the authority of Rafi` bin Khadij, he said: I heard the Messenger of God, may God bless him and grant him peace, say: “The evil of earning is the dowry of a prostitute, the price of a dog, and…” [4]. And the prohibition is carried on dogs that are neither for hunting nor for guarding livestock and farming, as Imam Sahnoun went to that.

The Messenger of God also commanded the killing of dogs [5], and Imam Malik carried it to every dog ​​that was taken other than hunting and cattle, and said: Whatever harms them is to be killed, and what is in a place should not be like Fustat, that is, cities, and that is not something that prevents goodness to them as soon as possible. Her life, and for her killers to be well done, do not take a purpose, and are not killed by hunger or thirst [6].

Some scholars said that it is permissible to take dogs in urban areas in homes for guard when there is fear of theft, and Ibn Abi Zaid al-Qayrawani took a dog in his house when the wall fell, and he was afraid for himself from the Shiites, and he was told about that, and he said: If the owner of our time realized, he would not take a ferocious lion. It is understood from this that those who said it is permissible considered fear for the soul and money that it is permissible to take dogs in homes.

But the saying adopted in the madhhab nullified this interest: Because it is rare in a corrupt, preponderant interview, and it is what harms people, neighborhoods, and pedestrians in urban areas, from harm, intimidation, and cuts off their calm, with the abundance and intensity of its barking, night and day, and it may harm those who are not thieves and those who have not stolen yet; And because guarding houses in urban areas is entrusted to their owners for their ability to protect their homes and tighten their closures, it is not measured against guarding crops, livestock, and inhabitants of the countryside, the wilderness and the fiafy [7]. Perhaps the house of Ibn Abi Zaid was not in Hatra, but was far from it.




It is worth noting that this dispute is related to guard and hunting dogs, which are known for their ferocity and ferocity. As for other dogs, there is no disagreement mentioned in them. Rather, it is not permissible to take them in homes with a single saying.What supports the inability to take dogs in homes, despite the unpleasant smell that they emit from them, is contrary to the purity and good smell that Islam calls for, what has been proven by modern science that dogs carry in their saliva dangerous types of bacteria that cause diseases that may end in death, and academic studies in So many. This is the secret of what came from the hadith of the Prophet, may God’s prayers and peace be upon him, by washing the vessel in which the dog ablates seven times, one of them with dirt. 8].
